Judge denies request for GM to "park it now"

U.S. District judge Nelva Ramos deferred to the National Highway Traffic Safety Administration (NHTSA) in denying a request by injured parties to force General Motors (GM) to issue a "park it now" on recalled vehicles. GM opposed the request and is pleased with the judge's decision. According to NBC News, GM states that "the vehicles are safe to drive as long as nothing extra is attached to the key while it is in the ignition."

Pharmaceutical companies must pay $9 billion

Takeda Pharmaceutical company of Japan and Eli Lilly in the U.S. have been ordered by a federal jury in Louisiana to pay a total of $9 billion in the first federal case in the U.S. involving the diabetic drug Actos.

Previous state cases in California and Maryland have been awarded over $8 million.

The companies were found liable for continuing to market the drug Actos even though they knew it could cause cancer.

General Motors corporation had told dealerships to stop selling 21,000 Chevrolet Cruze compact cars model years 2013-2014. Although the company has not confirmed why it is believed to possibly be related to recent ignition switch recalls that have taken place.

According to a report on msn news, more oil spilled from train rail cars in 2013 than in the last four decades, since the federal government began collecting the data. In 2013, 1.15 million gallons of crude oil spilled from rail cars. Compare that to the dates from 1975-2012 during which 800,000 gallons spilled in total.

Racist emails released by T.W.I.A.

The Texas Windstorm Insurance Association (TWIA) confirmed the release of "potentially offensive" emails in answers to discovery related to a lawsuit from the Brownsville I.S.D.  The alleged racist language used in the emails by Texas Windstorm Insurance Association employees disparaged Hispanics, African Americans and Arabs. A media relations spokesperson for the T.W.I.A. confirmed that some of the emails contained "blatantly offensive material." The lawsuit is still ongoing.

A Chevron gas pipeline exploded forcing the evacuation of the entire town of Milford, TX, south of Dallas. Local schools were forced to cancel classes and evacuate the children to a safer area. Fortunately there were no injuries.

FDA Warns on use of decorative/costume contact lenses

They are not cosmetics or over-the-counter merchandise. They are medical devices regulated by the Food and Drug Administration (FDA). Places that advertise them as cosmetics or sell them without a prescription are breaking the law.

They are not “one size fits all.” An eye doctor (ophthalmologist or optometrist) must measure each eye to properly fit the lenses and evaluate how your eye responds to contact lens wear. A poor fit can cause serious eye damage, including:

  • scratches on the cornea (the clear dome of tissue over the iris - the part of the eye that gives you your eye color)
  • corneal infection (an ulcer on the cornea)
  • conjunctivitis (pink eye)
  • decreased vision
  • blindness
  • Places that sell decorative lenses without a prescription may give you few or no instructions on how to clean and care for your lenses.

Failure to use the proper solution to keep contact lenses clean and moist can lead to infections, says Bernard Lepri, O.D., M.S., M.Ed., an optometrist at FDA. “Bacterial infections can be extremely rapid, result in corneal ulcers, and cause blindness—sometimes within as little as 24 hours if not diagnosed and treated promptly.”

“The problem isn’t with the decorative contacts themselves,” adds Lepri. “It’s the way people use them improperly—without a valid prescription, without the involvement of a qualified eye care professional, or without appropriate follow-up care.”

Nissan recalls over 188,000 SUVs to fix brakes

Nissan Motors is recalling Nissan and Infiniti brand SUVs due to faulty brake control software which could increase the risk of crashing. The recall includes Pathfinders 2013-2014 models and Infiniti 2013 JX35 along with 2014 QX60 models.

Owners should be notified within 60 days and the dealerships will fix the problem at no charge.

Reser's Fine Foods in Topeka, Kansas is recalling 22,800 pounds of chicken, beef and ham (bacon) products due to possible contamination with Listeria Monocytogenes.

Brands included in the recall include: Cobble Street Market, Cross Valley Farms, Reser's own brand name, Millers Bar-B-Que beans with beef, Classic Chicken Salad, Chef Solutions chicken salad, Stonemill Kitchens potato salad with bacon.

FDA Investigates Pet Injuries and Deaths

The Food and Drug Administration (FDA) is actively investigating the illnesses and deaths of pets around the country from jerky treats. Most treats are made in China where there is little regulation of the products. The FDA reports as of September 24th over 3,600 dogs and 10 cats have become ill. North Dakota wheat farm fouled by largest oil spill on U.S. soil in history

A wheat farmer in North Dakota discovered oil on his farm but it wasn't the type to make him rich, rather it was leaking from an underground pipeline and will take years to clean up. He won't be able to farm his own land until the oil is gone and he gets compensated for his losses. All grain within a half mile of the massive spill site cannot be sold for consumption.

It also appears that it took officials almost two weeks to notify the public of what was happening. Of course officials also claim no water has been contaminated and no wildlife has been affected.

The 20 year old pipeline is owned by Tesoro Logistics based in San Antonio, TX. It was originally built by BP around 1993.

Coast Guard investigating another oil platform fire off Louisiana

Nov. 17, 2012 Officials state the platform is in shallow water in the Gulf of Mexico. Reports now suggest four people injured and taken to hospital, two people missing.

The rig is located about 20 nautical miles southeast of Grand Isle, La.

The platform is owned by Black Elk Energy which was fined back in September $300,000 due to safety issues at a facility in 2011. More recently in August of this year the company was investigated by the federal Bureau of Ocean Energy Management Regulation and Enforcement (BOEMRE).

Social Security Administration adds 52 new conditions to compassionate allowances list

The Social Security Administration (SSA) operates a list of conditions that are fast tracked for social security disability. This list called the Compassionate Allowances list has over 165 conditions that allow disabled individuals to get approved for benefits quickly, meaning within days instead of months or even years. Goodyear Recalls 41,000 Tires

Goodyear Tire & Rubber Co. has issued a recall of 41,000 Wrangler Silent Armor tires produced in 2009 due to concerns of tearing in the tires that could lead to a crash. Two people died in a 2011 rollover involving these tires.

Nursing Home verdict upheld

A Houston court has upheld an $11 million nursing home case for a disabled fire victim. The woman suffered severe burns as a result of a deadly fire at a community-based living facility. The Harris County District declined to reduce the verdict to $250,000 under the state's health care liability damages cap.

Texas Oil Driller fined after death of 2 workers

An oil driller in Texas has been fined $93,700 after 2 workers died and serious violation were found at the drilling site. The deaths occurred in 2011 after the kelly bushing came apart and fatally struck the two workers on the drill floor. Tassimo Brewers and Espresso pads recalled

The Tassimo single cup brewer (not to be confused with the Keurig K-cup) manufactured by BHS Home Appliance Corp has issued a recall of more than 1.7 million single cup brewers and 4 million Tassimo espresso coffee pads after dozens of consumers were sprayed with hot liquid, several suffering severe burns. 37 reports of second degree burns have been reported including a 10 year old girl and a 2 year old which were hospitalized due to their second degree burns.

Consumers are urged to immediately stop using the units and pads.

Toyo Tire USA Corp recalls 69,000 tires

The tires are being recalled due to a kink near the rim area that could cause a crack and lead to tire failure. Only tires made from their plant in Georgia are affected. If tires note  "made in Japan" or " made in China" the tires are not affected by the recall. ID numbers on the tires range from 3809 to 4410. The company will replace tires at no charge before May 31st.

Pfizer recalls 1 million packets of birth control

A packaging error has lead to the recall of 1 million packets of birth control that could lead to inadequate dosage and an accidental pregnancy. This error affects Lo/Ovral-28 tablets, generic Norgestrel and Ethinyl Estradiol tablets.

Pfizer found some of the packets had too many active tablets while some had too few. A Pfizer statement says this is not a safety issue however there is an increased risk of unintended pregnancy.

Over-the-counter medication alert

Novartis Consumer Health Inc. is issuing a voluntary recall of several common over-the-counter medications including Excedrin, NoDoz, Bufferin, and Gas X due to damaged pills in bottles but more importantly some bottles may contain other medications. Please use caution and verify the pills that you are taking. The company is working with the FDA and has temporarily closed it's production plant in Nebraska.

Actos lawsuits get consolidation for Federal cases

A Louisiana court has agreed to consolidate all federal cases resulting from injuries caused by the diabetes drug Actos. Plaintiffs in cases had sought to transfer several cases back in August 2011 to the Southern District of Illinois.

Actos is a diabetic drug which has shown increased rates of bladder cancer when used over a one year period. The increased rate of getting bladder cancer is approximately 40%. After reviewing a 10 year study, the FDA in June 2011 required changes to the labeling to reflect this significant increased risk of cancer. The FDA further required medical professionals to stop providing Actos to patients with a history of bladder cancer. After results from studies in France and Germany both countries banned the use of the drug.

Obama Admin Decides Not to Lower Trucker Hours

The Obama Administration have decided not to cut the number of hours truck drivers can log on a daily basis. The new rule issued recently continues to permit drivers to be on the road for up to 11 hours a day but does reduce the maximum driving hours per week to 70. That's a reduction of 12 hours. The 34 hour gap between the end of one work week and the start of another remained unchanged. Further rules state driver must take a minimum 30 minute break between 8 hour shifts.

Dept of Labor announces changes to Longshore laws

The U.S. Department of Labor recently announced changes to the Longshore and Harbor Workers' Compensation Act which will begin January 30th. Under these changes workers who maintain or repair recreational boats and watercraft will be excluded from coverage. This means that laborers who build repair, or dismantle any recreational water vessel will no longer be covered by the Longshore Act. Some exceptions do apply.

CA man Awarded $7.5 Million after Slip and Fall at Starbucks

A California Superior Court jury awarded a Starbucks customer $7.5 million after a slip and fall that left the man with a brain injury. The man, a chiropractor by profession, was compensated for loss of income, medical expenses and loss of enjoyment of life. A Starbucks employee had just mopped the floor when he came in to get his coffee order. Not knowing how serious his injuries were, he did not go to the doctor until the next day after feeling persistent head pain, nausea and other symptoms. He was initially told he had a concussion but later that was updated to mild brain trauma, which required brain-injury therapy. He was not able to return to work. The best offer he received from Starbucks to settle the case was no more than $100,000 according to the man.

Build-A-Bear Company has recalled the Colorful Hearts Teddy Bears due to a choking hazard. It appears the eyes on the bear can easily become loose and fall off creating a choking hazard for small children. Although no choking reports have been reported thus far, the company has manufactured over 280,000 of these bears that have been sold across the United States. The bears are actually manufactured in China. Many consumers simply do not know how to report these incidents or are just glad their children are not harmed further. update to baby formula news: a third baby has tested positive for cronobacter infection. Mead Johnson Nutrition, the manufacturer of Enfamil has stated they have tested the formula and all the test are negative for bacteria. The U.S. Center for Disease Control (CDC) is investigating.

 

Wal-Mart pulls infant formula form stores nationwide

After a newborn baby in Missouri died while suing Enfamil infant formula, Wal-Mart has decided to pull the product nationwide. There has not been a government recall issued yet however the infant suffered a bacterial infection. The Manufacturer Mead Johnson Nutrition stated their records show the product was tested and the results were negative for bacterium before it was shipped.

BatteriesPlus LLC of Wisconsin is recalling over 111,000 battery units due to risks of sudden explosion which poses serious risk of injury to consumers. The recall involves Rayovac branded replacement battery packs for use with cordless power tools. The batteries were sold in stores nationwide and online from 2008 - 2011 for the following branded power tools: Black 7 Decker, Bosch, DeWalt, Makita, Milwaukee, Panasonic, Ryobi and Skil.

Consumers should stop using this product immediately.

Build-A-Bear Workshop Agrees to $600,000 Penalty

Build-A-Bear Workshop reached an agreement with the Consumer Products Safety Commission (CPSC) to pay a $600,000.00 penalty for defective products. Specifically the defective toy bear beach chair's sharp edges can pinch, lacerate and even amputate a child's fingertips. The company sold the chair between 2001 and 2008 online and in stores. The company became aware of several incidents starting in July 2007 but did not report to the CPSC until March 2009.

Recall of Marshall Gardens PatioGlo Fuel Gel  due to Burn Hazard

The hazard: the pourable gel fuel can ignite unexpectedly to the consumer and expel onto people and objects nearby when it is poured into a firepot that is still burning. This can occur even when the consumer does not see the flame or is not aware that the firepot is still ignited. Gel fuel that expels and ignites can pose a fire and burn risk to consumers that can be fatal.

There have been several reports of incidents resulting in injuries with burns requiring hospitalization.

Strollers Recalled by B.O.B. Trailers Due to Choking Hazard

The product is the B.O.B. single and double stroller models under the names BOB, Ironman, and Stroller Strides; manufactured between 1998 and 2010. About 411,700 units were sold in the United States.

The stroller canopy's embroidered logo backing can detach, posing a choking hazard to babies and young children.

Several reports of children mouthing on the detached patch have been reported including reports of gagging and choking.

The product was sold at Babies R' Us, REI and other children's stores including Amazon.com

FDA issues drug warning regarding birth defects

The FDA is informing doctors that chronic, high doses of Diflucan (fluconazole) during the first trimester of pregnancy may result in birth defects in infants. This same risk does not appear to be associated with single, low dose fluconazole 150mg to treat vaginal yeast infection (candidiasis).

It is suggested that women taking this drug should consult with their doctors. And women that become pregnant should notify their doctors immediately.

Recall of Bravo Sports/Disney branded pogo sticks

About 159,000 Disney branded pogo sticks are being recalled due to laceration hazard. The problem is the bottom rubber tip will wear out prematurely posing a fall hazard to children. Also the end caps on the handlebars come off, exposing sharp edges and posing a laceration hazard.

82 reports have been filed including injuries such as skull fractures, chip teeth, chin and lip cuts which required stitches, hits to the head and teeth pushed in.

The pogo sticks have Disney labels between the handlebars. The manufacturing date codes between 01/01/2009-022CO and 11/30/2010-022CO are on a clear label on the stem of the pogo stick near the foot pedals.

Sold at: Burlington Coat Factory, Kmart, Kohls.com, Target and Toys R Us from February 2009 through June 2011 for about $20.

Social Security Disability update

Starting today, July 28, 2011 the Social Security Administration (SSA) will not allow subsequent disability claims to be filed if you currently have a claim pending at the Appeals Council (AC) [SSR 11-1p]. This means that if you are denied by an Administrative Law Judge (ALJ) and you appeal to the Appeals Council (AC) you cannot start a second claim until the AC makes a final decision. Wm. Wright Co. Recalls Roman Shade kits due to Risk of Strangulation to children

In December of 2009 a number of manufacturers and retailers announced a recall of ALL Roman Shades and roll-up blinds.

About 48,000 kits were sold by the Wm. Wright Co.

The hazard of this product is the risk of strangulation can occur when a child places his/her neck between the exposed inner cord and the fabric on the backside of the shade, or when a child pulls out the cord and wraps it around his/her neck.

These kits were sold at Walmart, Jo-Ann stores and other retail locations.

Families are asked to stop using this product and ALL related Roman Shades and similar roll-up blinds.

Napa Home & Garden Recalls NAPAfire and FIREGEL Pourable Gel Fuel Due to Fire and Burn Hazards

Consumers should stop using recalled products immediately

Hazard: The pourable gel fuel can ignite unexpectedly and splatter onto people
and objects nearby when it is poured into a firepot that is still burning. This
hazard can occur if the consumer does not see the flame or is not aware that the
firepot is still ignited. Fuel gel that splatters and ignites can pose fire and
burn risks to consumers.

Incidents/Injuries: Napa is aware of 37 reports of incidents, including 23 burn
injuries to consumers.

Sold at: Bed Bath & Beyond, Shopko, Restoration Hardware, specialty and gift
shops, furniture stores, and home and garden stores nationwide, as well as
through Amazon.com, home and garden catalogs, and home decorators and landscape
architects between December 2009 and June 2011 for between $5 and $78.

Bunk beds recalled from Big Lot's due to Child's death

Big Lot's is recalling some 30,000 metal futon bunk beds.

Children behind the futon or in the ladder area of the bunk bed can get entrapped when the futon and its metal frame are lowered from the seated to the flat position. This is what happened to a three-year old Burlington, Iowa boy who died when he became entrapped at the head and neck in the recalled bunk bed in March of 2010. The weight of the futon's metal frame prevented the child from breathing and escaping. CPR was administered, but the child died at the hospital due to compression asphyxiation.

The bunk beds have an additional hazard. The space between the last rung on the bunk bed's ladder and the futon mattress is too small, which can allow a child's body to pass through, but not the head, posing a head and neck entrapment hazard.

The metal futon bunk beds have an upper bunk designed to hold a twin mattress. The bottom bunks have a convertible futon bed.

FDA increases warning on Chantix

The Food and Drug Administration (FDA) has provided increased warnings to doctors and healthcare professionals regarding the use of Chantix (varenicline). Studies have shown an increased risk of cardiovascular events such as heart attack from patients using Chantix. The FDA is recommending strengthening prescription information for this drug in order that doctors and patients will be able to determine the risks involved with using this drug. Meanwhile the FDA will continue to evaluate the cardiovascular safety of Chantix.

Dangerous confusion:

Risperidone (Risperdal) and Ropinirole (Requip): Medication Errors - Name Confusion

FDA notified healthcare professionals and the public of medication error reports in which patients were given risperidone (Risperdal) instead of ropinirole (Requip) and vice versa. In some cases, patients who took the wrong medication needed to be hospitalized.

The FDA determined that the factors contributing to the confusion between the two products include:
Similarities of both the brand (proprietary) and generic (established) names
Similarities of the container labels and carton packaging
Illegible handwriting on prescriptions
Overlapping product characteristics, such as the drug strengths, dosage forms, and dosing intervals.
BACKGROUND: Risperidone (Risperdal) is an antipsychotic medication used to treat mental illnesses including schizophrenia, bipolar disorder, and irritability associated with autistic disorder. Ropinirole (Requip) is a dopamine agonist used in the treatment of Parkinson’s disease and Restless Legs Syndrome.

 

Birth control and increased risk of blood clots

The Food and Drug Administration (FDA) has issued a new warning to all doctors and patients regarding birth control pills containing drospirenone. Two newly published studies indicate an elevated risk of venous thromboembolism (VTE) in women who use birth control pills containing drospirenone. This risk is reported to be up to 2 to 3 times greater than the risk of VTE associated with using levonorgestrel-containing pills.

Drospirenone is a type of female sex hormone called a progestin. Most birth control pills contain two types of hormones--estrogen and progestin. Birth control pills work by preventing the release of eggs from the ovaries (ovulation) and changing the cervical mucus and the lining of the uterus to prevent pregnancy. Brand names of drospirenone-containing products include Yaz (generics Gianvi and Loryna), Yasmin (generics Ocella, Syeda, and Zarah), Beyaz, and Safyral.

If your birth control pill contains drospirenone, do not stop taking it without first talking to your healthcare professional. Contact your healthcare professional immediately if you develop any symptoms of blood clots, including persistent leg pain, severe chest pain, or sudden shortness of breath. If you smoke and are over 35 years of age, you should not take combination oral contraceptives because they increase the risk that you could experience serious cardiovascular events, including blood clots.

 

Recall of pool, spa drain covers

Eight manufacturers have recalled over 1 million pool and spa drain cover due to water flow and entrapment hazards. There is a risk to swimmers and bathers. The drain covers were manufactured between December 2008 and April 2011.

 

Stihl trimmers, edgers, blowers recalled

According to the Associated Press (AP) the Consumer Products Safety Commission (CPSC) has issued a recall on more than 2 million Stihl gas powered products which include trimmers, brush cutters, KombiMotors, hedge trimmers, edgers, clearing saws, pole pruners and backpack blowers. The main concern is the fuel cap which could leak or spill resulting in a fire or serious burns. 81 reports have been received by the company so far.

Dream on Me Recalls Drop-Side Cribs Due to Entrapment, Suffocation, Laceration, and Fall Hazards

Name of Product: Full-Size and Portable Drop-Side Cribs

Importer: Dream on Me, Inc. of Piscataway, N.J.

Incidents/Injuries: CPSC and the firm know of 69 reports of incidents involving these cribs. A 1-year-old boy sustained a scratch to the nose when he became trapped between the mattress support and side rail of his portable crib. An 8-month-old girl sustained a minor injury on her head from exposed plastic hardware inside the portable crib.

Hazard:
* Full-Size Cribs: The drop-side rail hardware can break or fail, allowing the drop side to detach from the crib. When the drop-side rail partially detaches, it creates a space between the drop side and the crib mattress. An infant or toddler's body can become entrapped in the space, which can lead to strangulation and/or suffocation. A child can also fall out of the crib.
* Portable Cribs: The drop-side rail hardware can break or fail, allowing the drop side to detach from the crib or fall unexpectedly. In addition, the portable crib mattress support hardware and the drop-side release latch can break easily, and the slats can loosen or break and detach from the crib.
Children can also cut themselves on exposed hardware inside the cribs.

Sold at: Toys R Us, Walmart and Target stores nationwide and online at Amazon.com. The full-size cribs were sold from January 2006 to December 2009 for about $200. The portable cribs were sold from September 2007 to December 2009 for about $150.

Remedy: Consumers should immediately stop using these cribs

Battery Dangers

The U.S. Consumer Product Safety Commission (CPSC) has issued a strong warning regarding button and coin sized batteries. Studies have shown a huge increase in the number of injuries and fatalities as a result of children swallowing these small size batteries. The battery will get stuck in the child's throat or intestine resulting in a chemical discharge that will burn. This burning can destroy the esophagus or damage a blood vessel which results in internal bleeding. Many of these incidents can be misdiagnosed. Symptoms are similar to many children's problems including upset stomach and fever. Or even show no initial symptoms at all.

The CPSC warns parents to properly discard batteries; do not allow children to play with small batteries; never put batteries in your mouth; and seek immediate medical attention if a battery is swallowed or you suspect your child swallowed one.

This applies to small children primarily under age 4 and elderly adults who use hearing aids and can mistake batteries for medications.
